1. About these terms

These terms apply to painting and decorating work carried out by Everest Painters (“we”, “us”, “our”) for a customer (“you”) in Wānaka, Lake Hāwea and the surrounding Upper Clutha area. Accepting a quote means accepting these terms unless we have agreed something different in writing.

2. Quotes and pricing

• Quotes are provided free of charge and are based on the surfaces, preparation and number of coats described in the quote.
• Quotes are valid for 30 days from the date issued unless stated otherwise.
• Prices exclude GST unless the quote says otherwise.
• If hidden damage is found once preparation starts — rot, extensive flaking, failed substrate or previous coatings that must be removed — we will stop, explain the options and confirm any additional cost with you in writing before carrying on.

3. Access and site conditions

• You agree to provide reasonable access to the work area, along with power and water where required.
• Please move or advise us of valuables, artwork and fragile items before we start. We will cover and protect floors, joinery and fixtures as part of normal preparation.
• Exterior work depends on weather. Painting will not be carried out in rain, high wind, frost or temperatures outside the product manufacturer's stated range, so exterior timeframes may shift.

4. Products and colours

• Unless specified otherwise, we select trade-grade products suitable for the surface, exposure and use.
• Colour selection is your decision. We are happy to advise and to prepare test patches. Colours can read differently across surfaces and light conditions, and screen or brochure colours are indicative only.
• Where you supply your own paint, we cannot warrant the performance of that product.

5. Timeframes

We will give you an expected start date and duration. Dates are estimates made in good faith and may be affected by weather, additional work found on site, product supply, or delays caused by other trades.

6. Payment

• Invoices are payable within the period stated on the invoice.
• For larger jobs we may request a deposit or progress payments, which will be set out in the quote.
• Overdue amounts may incur reasonable recovery costs.

7. Workmanship

Work is carried out with reasonable care and skill. If you believe something is not right, tell us within a reasonable time and we will inspect it. Fair wear and tear, movement or cracking in the building substrate, damage caused by others, and failure of surfaces or coatings we did not apply are excluded.

8. Consumer rights

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply.

9. Photographs

We may photograph completed work for our own portfolio or social media. Tell us if you would prefer we did not, and we will not.

10. Liability

To the extent permitted by law, our liability is limited to remedying the affected work or refunding the amount paid for it. We are not liable for indirect or consequential loss.

11. Cancellation

Either party may cancel a booking by giving reasonable notice. Where materials have already been purchased or bespoke product has been tinted for your job, those costs remain payable.
